Einige Mitgliedstaaten \u00e4nderten ihre Luftverkehrsvorschriften sogar dreimal am Tag, was f\u00fcr alle Drohnenliebhaber \u00e4u\u00dferst frustrierend war, aber noch wichtiger ist, dass diese chaotische Situation auch den Drohnenbetrieb in der EU insgesamt \u00fcber viele Jahre hinweg zum Erliegen brachte.<\/p>\n\n\n\n<p>Doch diese Zeiten sind nun endg\u00fcltig vorbei! Die EU-Beh\u00f6rden haben schon vor einiger Zeit erkannt, dass sie die Rechtsvorschriften f\u00fcr Drohnen vereinheitlichen m\u00fcssen, damit alle Arten von intelligenten L\u00f6sungen ihre volle Leistung entfalten k\u00f6nnen. Und so einigten sich alle EU-Mitglieder nach einer internationalen Konsultation auf ein neues Regelwerk, das seit dem 1. Januar gilt<sup>st<\/sup>&nbsp;2021 und ersetzt die bestehenden Gesetze der einzelnen EU-Staaten und gilt f\u00fcr alle Drohneneins\u00e4tze. Er basiert haupts\u00e4chlich auf einem risikoorientierten Ansatz, bei dem der Drohnenbetrieb in drei verschiedene Kategorien eingeteilt wird: \"Offen\", \"Speziell\" und \"Zertifiziert\". Ich m\u00f6chte Ihnen die wichtigsten Punkte der neuen UAS-Verordnung (\"Unmanned Aerial System\", die EU bevorzugt diesen Namen gegen\u00fcber Drohnen) erl\u00e4utern und Ihnen im Jahr 2021 viel Zeit, Frustration und Kopfschmerzen ersparen...<\/p> <ol class=\"schema-how-to-steps\"><li class=\"schema-how-to-step\" id=\"how-to-step-1678953716763\"><strong class=\"schema-how-to-step-name\"><\/strong> <p class=\"schema-how-to-step-text\">Alle unbemannten Luftfahrtsysteme werden irgendwann das CX-Zeichen tragen m\u00fcssen, aber die Mehrheit der heutigen UAS-Ausr\u00fcstung ist nicht mit dem CX-Zeichen versehen. Die gute Nachricht? Die EU hat die \"Limited Open Category\" geschaffen, um einen \u00dcbergangszeitraum abzudecken, der am 01.01.2021 in Kraft trat und im Grunde eine zweij\u00e4hrige \u00dcbergangsfrist f\u00fcr alle Ger\u00e4te darstellt, die bis 2023 das CX-Zeichen erhalten sollen.<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1678953757564\"><strong class=\"schema-how-to-step-name\"><\/strong> <p class=\"schema-how-to-step-text\">Seit dem 01\/01\/21 m\u00fcssen sich alle UAS-Besitzer bei ihrer nationalen Zivilluftfahrtbeh\u00f6rde registrieren lassen, um ihre UAS-Betreiber-ID zu erhalten. In Belgien zum Beispiel m\u00fcssen Sie sich beim DGLV, dem lokalen Drohnenportal, registrieren lassen. Wieder einmal eine gute Nachricht! Sie m\u00fcssen sich nur einmal als UAS-Betreiber registrieren lassen, auch wenn Sie mehrere Drohnen besitzen. Die Registrierungsnummer, die Sie von Ihrer nationalen Luftfahrtbeh\u00f6rde erhalten, \u00f6ffnet Ihnen den gesamten EU-Himmel. Sie m\u00fcssen nur Ihre einmalige Registrierungsnummer auf alle Ihre UAS aufkleben und schon k\u00f6nnen Sie loslegen oder besser gesagt fliegen.<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1678953768972\"><strong class=\"schema-how-to-step-name\"><\/strong> <p class=\"schema-how-to-step-text\">Bevor wir uns n\u00e4her mit den Unterschieden zwischen den drei verschiedenen Kategorien (offen, spezifisch und zertifiziert) befassen, sollten wir die Versicherung nicht vergessen (eine spezielle Drohnenversicherung war ohnehin eine spezifische Anforderung f\u00fcr den britischen Markt). Positiv ist zu vermerken, dass Ihre Standard-Haftpflichtversicherung wahrscheinlich die meisten Freizeitaktivit\u00e4ten abdecken wird. F\u00fcr Drohnen \u00fcber 20 kg ist auf jeden Fall ein zus\u00e4tzlicher Versicherungsschutz erforderlich, aber erkundigen Sie sich bei Ihrem Versicherer, bevor Sie sich registrieren lassen.<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1678953785624\"><strong class=\"schema-how-to-step-name\"><\/strong> <p class=\"schema-how-to-step-text\">Die erste und f\u00fcr unsere Kunden sicherlich wichtigste Kategorie ist die \"Offene Kategorie\", die dann je nach Gewicht des UAS (grob gesagt von unter 250 g bis gut 25 kg) in Unterkategorien unterteilt ist. Die \"Offene Kategorie\" ist ein riesiger Beh\u00e4lter f\u00fcr alle risikoarmen Operationen innerhalb der Sichtlinie (kurz \"VLOS\") und nicht \u00fcber Menschen.<br\/>Als Ausnahme von der Regel d\u00fcrfen UAS unter 250 g weiterhin \u00fcber nicht verwandte Personen fliegen. Es ist keinerlei Schulung erforderlich und es ist kein Mindestalter festgelegt. Es wird jedoch empfohlen, dass Sie zumindest die Betriebsanleitung Ihres Ger\u00e4ts lesen und sich die kostenlose Online-Schulung f\u00fcr Betreiber \u2264 250gr ansehen.<br\/><br\/>UAS unter 900 g d\u00fcrfen nicht mehr \u00fcber Personen fliegen, die nicht mit ihnen verwandt sind, die Betreiber m\u00fcssen \u00e4lter als 14 Jahre sein und sie m\u00fcssen die kostenlose Online-Schulung absolvieren und eine relativ einfache Online-Pr\u00fcfung ablegen.  Dar\u00fcber hinaus sollte jeder Betreiber zumindest das Werkshandbuch seines UAS in- und auswendig kennen. Das Zertifikat, das Sie nach Bestehen der Online-Pr\u00fcfung erhalten, bleibt 5 Jahre lang g\u00fcltig.<br\/><br\/>W\u00e4hrend der \u00dcbergangszeit d\u00fcrfen UAS unter 2 kg in der Regel bis zu 50 Meter \u00fcber Menschen fliegen, was ziemlich nah an Infrastruktur und Maschinen liegt und somit genau unser Ding ist.  Unsere bevorzugte Drohne, die DJI Phantom 4 RTK, wiegt nur 1391 Gramm und passt genau in diese Kategorie!  Andererseits ist zu beachten, dass UAS \u00fcber 2 kg einen Abstand von 150 Metern zu Industrie-, Wohn-, Gewerbe- und Erholungsgebieten einhalten m\u00fcssen.  In Bezug auf das Gewicht von UAS ist weniger definitiv mehr!<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1678953796624\"><strong class=\"schema-how-to-step-name\"><\/strong> <p class=\"schema-how-to-step-text\">Um es wirklich einfach zu machen, wenn Ihr Vorhaben nicht unter die \"offene Kategorie\" f\u00e4llt, wird es zweifellos in die \"spezifische Kategorie\" fallen. Die dritte \"zertifizierte Kategorie\" lassen wir bequemerweise aus, da der offizielle Rahmen noch sehr unbestimmt ist. Diese au\u00dfergew\u00f6hnliche Kategorie wird nur f\u00fcr sehr risikoreiche Operationen, wie z. B. die Bef\u00f6rderung von Personen, verwendet.<\/p> <\/li><\/ol><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Besondere Kategorie<\/h2>\n\n\n\n<p>Typische Merkmale der \"spezifischen Kategorie\" sind ein etwas h\u00f6heres Risiko als bei der offenen Kategorie, Fl\u00fcge in einer H\u00f6he von mehr als 120 m AGL (\"Above Ground Level\"), au\u00dferhalb der Sichtlinie (BVLOS) und \u00fcber Menschen, einschlie\u00dflich Aktivit\u00e4ten wie das Abwerfen von G\u00fctern.<\/p>\n\n\n\n<p>F\u00fcr alle Eins\u00e4tze der \"spezifischen Kategorie\" mit relativ standardm\u00e4\u00dfigen Szenarien ist keine gesetzliche Genehmigung erforderlich, sondern nur eine Form der Kommunikation mit den \u00f6rtlichen Beh\u00f6rden. Im Grunde bedeutet dies, dass Sie sich und Ihren Betrieb auf einem EU-Drohnenportal registrieren m\u00fcssen, z. B. beim DGLV in Belgien (mobilit.belgium.be). Der DGLV best\u00e4tigt Ihnen den Empfang und diese Erkl\u00e4rung ist buchst\u00e4blich alles, was Sie brauchen, um Ihren Betrieb zu starten... \u00fcberall.  Ihre belgische Erkl\u00e4rung ist in allen EU-Mitgliedstaaten g\u00fcltig. Bevor Sie in ein anderes Land fliegen, schicken Sie einfach eine Kopie Ihrer Erkl\u00e4rung und die Empfangsbest\u00e4tigung des DGLV an die Zivilluftfahrtbeh\u00f6rde des betreffenden Landes. Die durchzuf\u00fchrende Risikoanalyse muss der Methode entsprechen, die speziell von der Europ\u00e4ischen Agentur f\u00fcr Flugsicherheit (EASA) als akzeptables Mittel zur Einhaltung der Vorschriften entwickelt wurde. In den EASA-Ver\u00f6ffentlichungen finden Sie weitere Einzelheiten zu diesem Thema, falls Sie diese ben\u00f6tigen.<\/p>\n\n\n\n<p>Und ob Sie es glauben oder nicht, das ist alles, was Sie wissen m\u00fcssen, um ab dem 1. Januar endlich Ihr drohnengest\u00fctztes Gesch\u00e4ft in der EU ankurbeln zu k\u00f6nnen<sup>st<\/sup>&nbsp;vorw\u00e4rts! Einige Kategorien werden in den n\u00e4chsten zwei Jahren zweifellos noch einer Feinabstimmung bed\u00fcrfen, und die lokale Auslegung im Vereinigten K\u00f6nigreich muss noch best\u00e4tigt werden, aber in der Zwischenzeit sollten wir die grenzenlose \u00dcbergangszeit in vollen Z\u00fcgen begr\u00fc\u00dfen und in den EU-Himmel aufsteigen!<\/p>","protected":false},"excerpt":{"rendered":"<p>Staaten mit neuen Vorschriften, die ab dem 1.
